OFFICE MEMORANDUM

Subject: Payment of Overtime Allowance in the revised pay to the employees of Defence Industrial Establishments governed by Factories Act,1948.

Consequent upon revision of pay structure as per the VI CPC recommendations, the matter regarding payment of OTA,as per revised pay to the employees of the Ddfence Industrial Establishments under 
Factories Act,1948 has been considered in consultation with the Ministry of  Labour & Employment and DOP&T.That Ministry have clarified that OTA is a statutory provision and it would be admissible to the employees covered under the  statutory provision of the Factories Act,1948 on the basis of revised wages with effect from the date the wages were revised.

2.OTA on the basis of revised wages after implementation of VI CPC recommendations, is subject to the conditions stipulated in this Ministry’s O.M No.14(1)/97/D(Civ-II) dated 1st July 1998.

3.This issues with the concurrence of Defence (Finance/AG/PB)vide their I.D No.133/AG/PB dated 18th April 2011 and after consultation with Ministry of Labour & Employment vide O.M.No.Z-16025/75/2009-ISH-II dated 14-01-2011.

    please lookin to the mater from OFB

    1)How will the benefits of ACP be granted if due between 01 .01.2006 and 31.08.2008
    The revised pay structure has been changed w.e.f. 01.01.2006 and the benefits of ACPS have been allowed till 31.08.2008. Hence, the benefits of revised pay structure would be allowed for the purpose of ACPS.
    (OM No.35034/3/2008-Estt. dated 9.9.2010)
    But till to day Ordnance Factory Dum Dum is not implement this order

    2). Whether the cases of grant of financial upgradation allowed under the ACPS between 01.09.2008 and 19.05.2009, the date of issue of the Scheme are be reviewed?
    Since the benefits of ACPS have been discontinued w.e.f. 01.09.2008, the cases settled between 01.09.2008 and 19.05.2009, in terms of previous ACP Scheme shall be reviewed. because MACPS order published on 19/05/2009 then why in between case not applied for ACPS?

    3)The cases of 4 grade grant
    The 4 grade structure settled on 31/12/2010 & effect on 01/01/2006 then why who have placed in between period in MCM treated as promotion we request that promotion treated after 31/12/2010 not from 01/01/2006 please clarified from OFB & DOPT please see the DOPT

    4 implementation of ZBB
    After 20/05/2003 new ZBB strength sanction from OFB from various factory then OFB guided that stop new ZBB by OFB instruction on15/01/2004 letter no 01/CR/A/I and further operation instruction on 18/042005 No.800/MC/A/I for fill-up new ZBB strength but OFDC could not fill the vacancy till 30/03/2006 OFDC fill MCM placement 31/03/2006 for this reason 44 No. MCM deprived they could placed MCM before 01/01/2006 due to OFDC negligence or other circumstance, delay promotion is not fault by the 44 person of MCM they have loss their benefit of 4grade structure also 6th.CPC facility please make arrange those are placement in between 21/05/2003 to 31/12/2005 and clarified why not they placed in that time from OFB
